Suddenlink.net Visitor Privacy Policy

This Suddenlink.net Visitor Privacy Policy ("Privacy Policy") applies to information that is collected from non-logged in visitors to home.suddenlink.net (the "Website"). It does not apply to information provided by Suddenlink customers when they register for an online account or log into their account via the My Account link on the Website. Such information is covered by the separate Suddenlink Communications Privacy Policy.

The Website is hosted and maintained on behalf of Suddenlink Communications and its affiliates (“Suddenlink”) by its service provider, Synacor, Inc. (“Synacor”). As used in this Privacy Policy, “we” or “our” refer to Suddenlink and/or Synacor acting on Suddenlink’s behalf. This Privacy Policy describes the types of information we may collect from non-logged in Website visitors (“Users”) and our practices for collecting, using, maintaining, protecting and disclosing that information.   1. Information Collected From Website Users

    1. Information Users Provide to Us. We may collect, maintain, and access certain information you provide and information collected from your use of the Website. We will collect information that can be associated with a particular User individually ("Personally Identifiable Information" or "PII") when the User voluntarily provides it to us. For example, certain Website features may ask that you provide PII. You can visit and use the Website without providing us PII. PII does not include aggregated data, anonymized information, or other information that does not identify a particular person. We may generate anonymized or aggregated information from the information we collect. This is information from which any PII has been removed. Our collection, use, and disclosure of anonymized and aggregated information is not subject to any of the restrictions in this Privacy Policy.
    2. Information Automatically Collected on Website: When a User visits our Website we may collect their Information in the following ways:
      • Cookies. We and our service providers use "cookies" to collect information about your visit to our Website and to manage information concerning your preferences. A cookie is a small encrypted computer code added to a file on your computer as a record of your visit. It does not collect or provide your name or any other personal information about you.       • Passive Automatic Electronic Collection. We and/or our service providers collect and log information automatically when a User visits our Website. For example, we collect your IP address, the name and location of your Internet service provider, the type and version of your browser, the length of time you visit the Website, your search queries on the Website, the average number of pages you viewed and views and interactions with content and advertisements. We use this log information for systems administration purposes and for technical troubleshooting. We may also use it to gather general demographic information about you, such as your general location.
    3. Location Information. We and/or our service providers may collect information about your location when you visit the Website, which we use to enhance your experience when using the Website. Your location can be determined with varying degrees of accuracy by: browser or device-provided location information; IP address; information about things near your device, such as Wi-Fi access points, cell towers and Blue-tooth enabled devices; and zip code. The types of location data we collect depends in part on your device and account settings. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.     5. Information Collected From Children. The Website is not directed at, or intended for use by, children under the age of 13 and we do not knowingly collect PII from anyone under the age of 13. Children should always get permission from a parent or guardian before sending personal information over the Internet. If you believe your child may have provided us with personal information, you can contact us and request that we delete the information.   2. How We Use Your Information. We use information that we collect about you or that you provide to us, including any personal information, to:
    • Present our Website and its contents to you;
    • Diagnose problems with our services and/or software;
    • Administer our Website;
    • Gather demographic information;
    • Accumulate and report aggregate statistical information relating to the Website and User activity;
    • Maintain the Website and make improvements or upgrades when necessary;
    • Provide you with technical support and for system maintenance;
    • Inform you of new products or services that may be of interest to you;
    • Prevent fraud, including the unauthorized use of this Website or our services or violations of applicable policies and terms of service;
    • Ensure our own compliance with the law;

  3. Disclosure of Your Information

    1. Service Providers. We may provide access to User information, including PII, to third party service providers to assist us in providing the Website or for other legitimate business purposes. For example, we may use a User’s information to facilitate the display of ads for our products and services shown to the User on other websites and services across the Internet. When we do this, we may provide third party service providers with access to certain User information in order to place de-identified coded data into cookies on the User’s browser (or employ similar technology), and to provide the User with more relevant offers and updates through display media.
    2. Altice Affiliated Businesses. We may share Information, including PII, with Altice affiliates that assist us in providing the Website or our services. We may also share User information, including PII, with a successor company or other Altice entities in the event of a merger, acquisition or sale of all, or components of, our business.
    3. Authorized Parties With Your Consent. We may disclose PII about you to third parties with your consent.
    4. Third Parties for Marketing Purposes. Subject to Section 6 below, we do not and will not sell, license or rent Users’ PII to unaffiliated third parties without the required consent to do so. We may provide anonymized information to third party advertisers, to provide you with information or offers about products or services we believe may be of interest to you, or to assist third parties with media efforts. We may also share anonymized or aggregate Information with third parties for other uses of their own provided they commit not to re-identify the information.
    5. When Required by Law or to Protect Suddenlink or Others. We may access, preserve and disclose your Information, including your PII, if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to: comply with legal process; enforce our Terms of Service, Privacy Policies, or other contracts with the User; respond to claims that any content violates the rights of third parties; or protect the rights, property or personal safety of Altice, its agents and affiliates, its users and the public.
  4. Data Security. We protect against the loss, misuse and alteration of the PII we collect through the use of appropriate administrative, technical and physical safeguards. Our servers are protected by reasonable physical and electronic security measures, and we use encryption wherever required or if we feel it is otherwise warranted. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect Users’ PII, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of PII is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

     

  5. Choices About How We Use and Disclose Your Information.

    1. Interest Based Advertising. Some advertising that you see on the internet or in mobile applications on your devices are tailored to your interests and based on your activity online or in the mobile applications. If you do not wish to receive interest based ads based on your browsing activities and interests, you may opt out of most such advertising by going to the following websites operated by industry trade and self-regulatory organizations: http://networkadvertising.org/choices (operated by the Network Advertising Initiative) or http://www.aboutads.info (operated by the Digital Advertising Alliance).
    2. California Opt Out of Sale. If you are a California resident ("CA Resident"), you can opt out of the sale of your personal information. As described in Section 6 below, we do not sell Website Users’ personal information, meaning we do not collect personal information and transfer it to third parties for valuable consideration.
  6. Your California Privacy Rights. The California Consumer Protection Act (CCPA), Cal. Civ. Code §§ 1798.100-1798.199, requires that "Businesses" (as defined in the CCPA) provide CA Residents with information regarding the personal information collected, disclosed and sold about them. The CCPA definition of personal information ("CA Personal Information") is broader than the definition of PII we use in this Privacy Policy (see Section 1.a above) and also includes location information (see Section 1.c above) and information collected automatically on the Website as described in Sections 1.b. and 1.d, such as IP address, cookie IDs and device IDs, to the extent such information is reasonably capable of being associated with or linked to a particular consumer or household.

    CA Residents have the right to know the CA Personal Information collected, disclosed or sold about them by a Business, the right to request the deletion of the CA Personal Information the Business collects from them (subject to certain exceptions), the right to opt-out of the sale of their CA Personal Information, and the right not to receive discriminatory treatment by the Business for exercising any of these privacy rights.
    1. Collection of CA Personal Information. Cal. Civ. Code § 1798.140(o) contains a list of categories of CA Personal Information.     4. Disclosure and Sale of CA Personal Information; Opt-Out of Sale. The CCPA distinguishes between the disclosure of CA Personal Information for business or commercial purposes and the “sale” of CA Personal Information, which is broadly defined to include making such information available to a third party for monetary or other valuable consideration. For purposes of this policy, we consider our sharing of CA Personal Information as described above to be a disclosure for business purposes, not a sale. We do not sell the personal information of CA Residents, including any CA Resident who is a child under the age of 17. This Website allows Synacor’s third party partners to utilize tracking technologies to collect User information for advertising purposes. This collection and use of User information is governed by each third party partner’s specific privacy policy.     5. Right to Know and Deletion Requests. CA Residents have the right under the CCPA to request that we disclose the categories and/or specific information of CA Personal Information we have collected about them, subject to our ability to verify the requestor’s identity. CA Residents also have the right to request that we delete the CA Personal Information we collected from them, subject to certain exceptions and, again, our ability to verify their identity.

      For all CA Resident Users, the categories of information we collect, the categories of sources of that information, the business or commercial purposes for which the information was collected, and the categories of third parties with whom it was shared are described above.

      As the only CA Personal Information collected from CA Residents in the prior 12 months, is information collected automatically when a User visits the Website, we have no reasonable way to verify a CA Resident User’s identity. As such, we cannot honor requests to know specific pieces of information collected or deletion request with respect to this information.

    6. Authorized Agents. CA Residents may use an authorized agent to submit an opt-out request on their behalf provided that the CA Resident gives the authorized agent written permission to do so. We may deny a request from an authorized agent that does not submit proof that they have been authorized to act on the CA Resident’s behalf.

    8. Shine the Light Law (Cal. Civ. Code § 1798.83). A separate California law requires that we provide CA Residents with notice and choice with respect to the disclosure of their personal information to third parties for marketing purposes. If you request it, we will provide you with a notice of your right to prevent sharing of your personal information as well as a cost-free means of doing so. You may request such a notice by submitting a written request to [email protected] specifying that you seek your "California Customer Choice Notice." Please allow thirty days for a response.
  7. Changes to this Privacy Policy. We may change this Privacy Policy at any time. We will notify you of material changes by posting the revised Privacy Policy on the website. We encourage you to periodically review the Policy to inform yourself of any changes. The revised Policy will be effective on the date it is posted unless the revised notice states otherwise. You understand and agree that, if you use the Mobile Service after the effective date of the updated Privacy Policy, Altice will consider your use as acceptance of the updated Privacy Policy. If we make material changes that will result in a new use, disclosure, or permission of access to PII previously collected, we will obtain your appropriate consent before implementing such change as required by applicable law.
